Terms of Service

These terms of service ("Terms") govern your access to and use of Tradata (the "Service"), operated by Tradata, Inc. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Tradata provides AI-powered automation infrastructure for commercial lending and Non-QM mortgage operations. The Service includes document ingestion, income extraction, anomaly detection, DTI calculations, and audit-ready reporting. You may upload files (such as bank statements, 1099s, and borrower documents) for processing. Tradata validates, calculates, and flags data according to custom credit overlays and exports transparent results.

2. Customer Content and Data

You own all data you upload to the Service ("Customer Data"), including borrower financial documents. You grant Tradata a limited license to host, store, process, and analyze your Customer Data solely to operate the Service, perform calculations, and maintain regulatory compliance.

We treat all Customer Data as strictly confidential. Given the sensitive nature of mortgage data, we apply enterprise-grade security measures (including AES-256 encryption and SOC 2 compliant infrastructure) to protect Customer Data at rest and in transit.

3. AI Features and Underwriting Disclaimer

Tradata utilizes advanced infrastructure to extract data and calculate income. While we prioritize 100% explainability and cite all sources, the Service acts as an assistant to your human experts. You acknowledge and agree that:

  • You are responsible for reviewing and validating Tradata's audit trails before acting on them.
  • Tradata output does not constitute financial, legal, or audit advice.
  • Final lending, credit approval, and disbursement decisions remain 100% yours. Tradata is not a licensed mortgage underwriter or credit reporting agency.

4. Intellectual Property

As between Customer and Tradata, Customer owns all right, title, and interest in the Customer Data and the calculated outputs generated for them. Tradata owns all right, title, and interest in the Platform, its underlying AI models, infrastructure, algorithms, and aggregated/de-identified telemetry data used to improve the Service.

5. Acceptable Use

You agree not to (a) use the Service for any unlawful purpose or to facilitate fraud; (b) upload data you do not have the legal right to process; (c) reverse-engineer, decompile, or attempt to discover the source code of the Platform; or (d) use the Service outputs to train a competing artificial intelligence model.

6. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TRADATA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADATA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS ARISING FROM YOUR USE OF THE SERVICE, REGARDLESS OF WHETHER TRADATA WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising out of these Terms shall be resolved via binding arbitration in Delaware.
